Thabo Bester’s New Lawyer Warns of Mental Health Risks Due to Prison Conditions

Convicted murderer and rapist Thabo Bester’s new legal representative has raised serious concerns about his client’s mental well-being, urging that an application regarding Bester’s prison conditions be addressed promptly.

Advocate Lerato Moela, who is Bester’s sixth lawyer since the commencement of his case, emphasized the urgency of the situation during a pre-trial hearing at the Bloemfontein High Court on Wednesday.

Pre-Trial Proceedings and Legal Concerns

Bester, who escaped from the Mangaung Correctional Centre two years ago before being apprehended in Tanzania with his accomplice Dr. Nandipha Magudumana, appeared in court for pre-trial proceedings. Magudumana and seven other individuals face multiple charges, including fraud, money laundering, tampering with a corpse, and aiding in Bester’s escape.

During the hearing, Advocate Moela presented an application that highlighted Bester’s dire living conditions at the Kgosi Mampuru C-Max Prison. Moela insisted that this application should be prioritized before any further progress in the case. However, Judge Cagney Musi dismissed the urgency of the application, citing procedural issues.

Judge’s Response

Judge Musi stated, “The people I am told you have cited are not before me yet. I am told the Department of Correctional Services, minister of police, and the commissioner are also cited, but I do not even know whether the papers are served. Let us wait.”

This response underscores the need for proper procedural adherence before the court can address the application regarding Bester’s prison conditions.

Concerns About Mental Health

Advocate Moela warned that Bester’s mental health might be severely compromised if the issues surrounding his living conditions are not addressed expeditiously. During a previous court appearance in July, Bester had an emotional outburst, expressing distress over his treatment in prison. Moela reiterated the potential mental health risks, stating, “If Besterโ€™s application, which also addresses the conditions of his detention, is not prioritized, there may not be a Bester to speak of.”
